Terms of Use
These terms are an agreement between you and Vedran Vucko, an individual (referred to as “we”, “us” or “the Service Provider”), covering your use of the Prana Vidya mobile application for iOS and Android (the “App”). By installing or using the App you agree to these terms. If you do not agree, do not use the App.
Our Privacy Policy explains what information the App handles. It forms part of these terms.
1. What the App is
Prana Vidya is a pranayama practice app. It provides a breathing timer with measured ratios, a Body Oxygen Level Test (BOLT) score, a guided training progression, lessons on breathing, and background sounds. It is educational and wellbeing content. It is not a medical device, it does not diagnose or treat any condition, and nothing in it is medical advice.
2. Health and safety
Breathing practice is generally safe, but breath-holding and carbon dioxide tolerance work place real demands on the body. Please read this section carefully.
- This is not medical advice. The App is for education and wellbeing. It does not replace advice from a doctor or other qualified health professional.
- Check with a doctor first if you are pregnant, or if you are managing a health condition. This matters in particular for cardiovascular conditions (including heart disease and high blood pressure), respiratory conditions (including asthma and COPD), epilepsy or other seizure disorders, and anxiety or panic disorders.
- Stop and seek help if you feel dizzy, breathless, faint or unwell during a session.
- Never practise breath-holding while driving, operating machinery, swimming, bathing, or anywhere in or near water.
- Go gradually. Use the App’s baseline ratios and let the Trainer’s progression set the pace rather than forcing longer holds.
You are responsible for deciding whether the practices in the App are suitable for you. If in doubt, ask a clinician.
3. Your licence to use the App
You must be at least 13 years old to use the App, or older if the law where you live sets a higher minimum age for using online services without a parent’s consent.
We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use, in line with these terms and the rules of the App Store or Google Play.
You must not:
- copy, modify, distribute, sell or rent any part of the App or its content;
- scrape, extract or republish the lessons, quotes, sounds or other content;
- reverse engineer or attempt to obtain the source code of the App, except where the law expressly allows it;
- use the App for anything unlawful, or in a way that could harm the App or other people’s use of it.
4. Accounts
You can use the App without an account. Signing in with Apple or Google is optional and enables your practice history and settings to sync across your devices. You are responsible for keeping access to your Apple or Google account secure.
You can delete your account from within the App, or by following the steps on our account deletion page. Deletion is permanent.
5. Subscription, free trial and renewal
Some parts of the App require a paid subscription called Prana Vidya Pro. At present Prana Vidya Pro unlocks the Trainer’s guided progression, the Learn courses and lessons, and the premium background sounds library. We may change what is included over time.
Plans. Prana Vidya Pro is offered as a monthly plan and an annual plan. You choose the plan on the purchase screen. The price for each plan is shown there in your local currency before you buy, and prices may vary by region.
Free trial. Eligible users may start with a seven-day free trial. There is no charge during the trial. When the trial ends, your paid subscription begins automatically and the first charge is taken at the plan price shown when you started the trial, unless you cancel at least 24 hours before the trial ends. Where the platform’s rules provide for it, any unused portion of a free trial is forfeited when you purchase a subscription.
Auto-renewal. Your subscription renews automatically at the end of each billing period, at the then-current price for your plan, unless you cancel at least 24 hours before the end of the current period. Your Apple or Google account is charged for the renewal within 24 hours before the end of the current period.
How to manage or cancel. Subscriptions are managed and cancelled in the subscription settings of your Apple App Store account or Google Play account, not inside the App and not by contacting us. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
Payment. All purchases are processed by Apple or Google through their stores. We use a subscription service called RevenueCat to recognise your purchase in the App. We never see or store your card or payment details.
Refunds. Refunds are handled by Apple or Google under their own policies. We are not able to issue refunds for purchases made through the stores.
Restore. If you reinstall the App or change devices, use the Restore action on the purchase screen to recover a subscription linked to your Apple or Google account.
6. Content, credits and trade marks
The App, its design, code, lessons, and original content belong to us and are protected by copyright and other laws. Except for the licence in section 3, no rights are granted to you.
The App quotes from books, journals and classical texts. Each quotation is used under a declared basis, either public domain or fair use, with attribution to its source and publisher, and within limits on length and on how much is drawn from any one work. Bundled sounds, images and fonts are used under their respective licences. Two bundled fonts are used under the SIL Open Font License; the full licence texts are available on the Licences screen in the App.
The BOLT test is credited to Patrick McKeown, who adapted the Control Pause from Dr Konstantin Buteyko’s method. Oxygen Advantage® is a registered trade mark of its owner. This app is not affiliated with, endorsed by, or sponsored by Oxygen Advantage®. Other names and marks mentioned in the App belong to their respective owners and are used only to describe or credit them.
7. Your content
Anything you create in the App, such as presets, bundles, and session notes, remains yours. Where you sign in, you give us permission to store and sync that content so the App can work across your devices. We do not use it for any other purpose.
8. Apple Health
On iOS, with your permission, the App writes your completed sessions to Apple Health as Mindful Minutes. The App does not read any data from Apple Health. You can withdraw this permission at any time in the Health app or in your device settings.
9. Changes to the App and to these terms
We may add, change or remove features, content and third-party services, and we may update these terms. If we make a material change to these terms we will update the effective date at the top of this page and, where appropriate, let you know in the App. Continuing to use the App after a change means you accept the updated terms.
10. Ending your use
You can stop using the App at any time by deleting it. If you have a subscription, remember to cancel it in your store settings; deleting the App does not cancel a subscription. We may suspend or end your access if you breach these terms.
11. Disclaimer and limitation of liability
The App is provided “as is” and “as available”. To the extent permitted by law, we do not guarantee that the App will be uninterrupted, error-free or suitable for your particular needs, and we are not liable for any loss or injury arising from your use of the App or from any practice you undertake with it, except where that loss is caused by our negligence or cannot be excluded by law.
Your consumer rights. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that the law where you live gives you and does not allow to be excluded. For users in Australia this includes the Australian Consumer Law; for users in the European Union, the United Kingdom and elsewhere it includes your local consumer protection laws. Where our liability can lawfully be limited, it is limited, at our option, to supplying the service again or paying the cost of having it supplied again.
12. Additional terms for the Apple App Store
If you downloaded the App from the Apple App Store, the following also applies, as Apple requires.
- These terms are between you and us only, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the App to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, and consumer protection or similar claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any claim that the App infringes a third party’s intellectual property rights.
- You confirm that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and that you are not on any United States Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when using the App, such as your mobile carrier’s terms.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
13. Governing law
These terms are governed by the laws of Australia, and disputes will be dealt with by the courts of Australia. If you live in a country whose consumer law lets you bring a claim in your own courts or under your own law, nothing here takes that right away.
